How the Right Attorney Can Help Your Case

After an accident, it is important that you focus on getting the medical care you need as soon as possible. However, once you are stable enough, you should discuss your rights and options with a lawyer.

The right lawyer can help with the following and more:

Identifying Liable Parties

In order to seek compensation for your losses, you must identify who should be held responsible for your injuries. Sometimes, it is an individual, such as another driver. However, companies can also be liable for personal injuries, including manufacturers, stores, trucking companies, construction companies, nursing homes, employers of negligent employees, and others. Determining the right parties to file claims against can be a difficult process.

Calculating Damages

Many injury victims add up their medical bills and assume that is the value of their claim. With legal assistance, you may learn that your claim is worth significantly more. A skilled personal injury attorney can accurately calculate your damages, which may include payment for past and future medical expenses, past and future lost earnings, pain and suffering, permanent disabilities of disfigurement, mental trauma, or wrongful death.

Insurance Claims

The personal injury process generally begins with insurance claims against the insurers of the parties liable for your accident. Insurance companies are notoriously difficult to deal with, however, and they often work to challenge valid injury claims. You should never accept a settlement offer from an insurance company without first discussing the claim with an attorney, as these settlement offers are usually far less than you deserve. A lawyer can handle the entire process and negotiate the payment you deserve for all your past and future losses.

Have Questions?

  • How do I know if I have a case?
If you, or someone close to you has suffered a personal injury, loss of life, or financial loss due to the negligent, reckless or wrongful conduct of another, OR if your rights were violated in a place of employment, then you may have a case. It is important that you seek out the representation of a qualified, experienced law firm with a track record of success in the type of case you are presenting. (See “Cases We Handle” above.)
  • When should I file my personal injury claim?

Various time limits, called "statute of limitations" apply in different types of cases. Failure to file your claim within these time limits is fatal to a case. This means, that if a claim is not filed in time, the person with the claim is forever barred from being able to get compensation for their injuries. It also releases the person responsible for the injury from any liability. The statute of limitation in most personal injury cases is two years. In cases where the defendant is a public entity (e.g. city, county, or state), the time limit is six months. In many other cases the limit is only one year. It is therefore very important that you contact a qualified, experienced attorney immediately to represent you in filing your claim in a timely manner.

  • How do I deal with an insurance company?

Your insurance company: Be cooperative and provide them the information they request in a timely manner. They should be on your side and should assist you in your claim for medical expenses and property damage.

Opposing party’s insurance company: You take a serious risk in speaking to the other party’s insurance company on your own behalf. They will document everything you say and then use it against you later. It is very important to have a qualified, experienced attorney on your side to be your spokesperson in negotiations with the other party’s insurance company. They are trained and skilled at manipulating you in order to minimize the value of your claim, or defeat it all together.

  • How much does it cost to retain an attorney?

Most personal injury firms, including ours, provide a free evaluation of your case and work on what is known as a contingent fee basis. This means that unless the law firm wins your case, through settlement or at trial, you pay nothing for their services or their out-of-pocket expenses. Payment to the law firm is therefore “contingent” upon the outcome of the case. Virtually all personal injury firms charge a percentage of the amount recovered ranging from 25% to 50% depending on the firm. It is therefore very important that you hire a law firm that can get you the largest settlement possible. It is through our experience and long history in the personal injury field of law, that we are by far the most qualified firm you can hire to represent you.

  • How much is my case worth?

Many law firms will give you a quick opinion on the value of your case to get you in the door. This can be misleading as there are many legal and factual questions that need to be resolved before an accurate valuation can be made. It is possible to give an approximate range of value after some initial investigation of the case. However, an accurate estimation of value considers several important factors. For instance, who is at fault, type and severity of injuries, causation and collectability to name a few. It often takes significant investigation and work up of the case to be able to put together the value estimation of a case. Schedule a consultation with the Cartwright Law Firm today to get a better assessment on the potential value of your claim.
